Sponsoring a Family Member to Canada
Under Canadian Immigration Law, Canadian citizens and permanent residents living in Canada may sponsor close family members, living either in Canada or abroad, to become permanent residents.
The following are the types of relatives that can be sponsored to Canada under the Federal Family Sponsorship Category:
1. Spouses; (either opposite or same-sex);
2. Common Law Spouses ( either opposite or same-sex);
3. Conjugal Partner ( either opposite or same-sex);
4. Children;
5. Parents;
6. Grandparents;
7. Orphans;
8. Adopted Children;
9. Other relative category.
Exceptions on Rules of the Sponsoring
An exception to the normal procedure that the sponsor must be in Canada in order to sponsor, A Canadian Citizen may sponsor a spouse, common law spouse, conjugal partner or child(ren) while living outside of Canada provided that the Canadian Citizen sponsor intends on moving back to Canada with his sponsored family member(s) once they have obtained permanent residency status. This exception is not available for permanent residents of Canada.
Other Rules
Medical
All sponsored relatives are required to undergo a medical test and obtain criminal record clearances. In some situations a negative medical decision can be overcome on humanitarian and compassionate grounds.
Financial Requirements
With the exception of the sponsorship of spouses and dependent children all sponsors are required to meet financial requirements of sponsorship which entails proving that the sponsors has the ability to provide for the sponsored relative(s) in consideration of the sponsor’s financial obligations to other dependents.
Provinces
Note, some Provinces of Canada have their own immigration programs whereby a sponsor from that Province may apply to sponsor other family members such as brothers and sisters or other relatives.
